Nowadays many Animal Lovers and feeders are facing so many issues like- harassment, fights, arguments, and other kinds of harsh situations while feeding or rescuing stray dogs and other animals.

  •  HIGH COURT PASSED AN ORDER ASKING THE POLICE TO PROVIDE PROTECTION TO DOGS AND DOG FEEDERS:-

As per the High Court of India, there are some clear guidelines for both street dogs and their feeders that anybody an individual or a committee can't relocate, prohibit or remove the street dog from their locality or territory if anybody found doing this it is clearly a punishable offence. 

These Guidelines are the same for the dog feeders they have full rights to feed street dogs in their locality or in some other locality. This is totally legal nobody can stop you from feeding street dogs it is a punishable offence to stoping, restricting, or removing respective dog feeder from that particular area.

Even the police officials will provide protection to every feeder and their dog if needed.

  • SECTION 503:- INDIAN PENAL CODE 1860, PROVIDES THAT INTIMIDATION IS AN CRIMINAL OFFENCE WHICH IS COGNIZABLE.

According to this section of Indian penal court, anyone who threatens, stoping or Intimidates any person who is taking care of dogs or a dog feeder is liable for criminal intimidation under section 503 of Indian penal code and can be arrested without any warrant. 

So next time if anyone stopping, threatening, or starts fighting with you just because you are feeding some dogs so you can file a complaint against that person or a committee without any hesitation.

  • SECTION 506:- IT IS A CRIME TO THREATEN, ABUSE OR HARASS NEIGHBOURS WHO FEED ANIMALS.

Yes, Nowadays many Dog lovers are facing this kind of issues their neighbours or people who reside in the same colony starts fighting with them and sometimes threatening them because of their feeding activity.

Any Dog lovers who are facing this kind of issue can file a complaint against that particular person so no other person can do this again with any dog lover.


  •  I.P.C SECTION 428 & 429:-

According to the Indian Penal Code Section 428 & 429, any individual or committee trying to dislocate, abduction or doing any kind of cruelty with any community pet or any individual animal like stray dogs and cows will get the punishment under this section of the Indian Penal Code.

The Punishment Can be a Fine or up to 5 Years of Imprisonment. So it is our duty to file a complaint if we see someone doing any type of Cruelty towards an animal.

  •  DELHI POLICE ACT 1968, SECTIONS 73 TO 79, 99:- 
According to this Delhi Police Act, any police officer can arrest the person committing cruelty towards the animal in his presence without any arrest warrant.

It means that the police officer doesn't need an arrest warrant from Magistrate to arrest that person. Officer can take the decision by their own according to the situation if the animal needs any kind of medication or fist aid so its the officer's duty to take him to Veterinary Professionals.

If the animal is dead or unable to go anywhere so the officer has to make a suitable report according to the situation.


  • SECTION 11 OF THE PREVENTION OF CRUELTY TO ANIMALS ACT:- MAKES ALL ANIMAL CRUELTY A CRIMINAL OFFENCE.

Under this section of the Prevention of Cruelty to Animal Act, all animals are covered it means no animals can be harmed by any person or committee in any manner.

If a person or committee were found doing any of such things towards any animal then according to the Indian Penal Court they have to submit the fine amount or to be imprisoned according to their level of crimes.

  • THE ANIMAL BIRTH CONTROL (DOG) RULES, 2001:-

According to the Animal Birth Control (Dog) Rule 2001, it is requested to all the dog lovers, caretakers and their feeders to be a part of annual Sterilization meet and to take care of sterilizing stray dogs of their locality as well as the vaccinations and kindly keep all the regarding documents.

This rule is so important to stabilize/reduce the stray dog population and eliminating the risk of Rabies.
As well as to prohibits the relocation of stray dogs, i.e. throwing, or driving them out of one area, into another. 


  • STRAY DOG MANAGEMENT RULES 2001:-

It is Illegal for an Individual, RWA or Estate Management to remove or relocate dogs even the Municipality Department can't remove any stray dog but they have to be properly Sterilized and Vaccinated.

Nobody can remove the dogs from their territory permanently if the Municipality Department is taking any dog for Sterilization purpose they have to leave that dog in his territory back after the whole process of sterilization it is Illegal to leave any dog in a different territory or locality.

  • A NOTIFICATION BY MINISTRY OF PUBLIC GRIEVANCES AND BY ANIMAL WELFARE BOARD OF INDIA:-
As per this notification, any animal feeder who is feeding in their colony, or in the locality, nobody can stop or harass the feeder while feeding strays.

local RWA's or any other authorities can't stop you from feeding or treating them. It is totally against the law nobody can stop any animal feeder from feeding animals.

As per the Supreme Court of India all people who feed or help stray animals have rights to do it peacefully, the only thing which is needed is the records of every stray animal about their vaccinations or their sterilizations for showing if somebody wants to see so nobody can raise questions against any stray animal or their feeders.

  • THE SUPREME COURT OF INDIA GAVE A SIMILAR STAY ORDER AGAINST REMOVAL CULLING OR DISLOCATION OF A DOG ANYWHERE IN INDIA:-

As per the order of the Supreme Court of India, a stay order is applied in Pan India against dislocation or removal of any stray dog in anywhere in India.

It means nobody can remove or dislocate any stray dog from their territory or locality to another place or territory. This is totally illegal even if the Municipal Department is taking any dog for sterilization purposes or for vaccinations they have to leave that dog back again in the same locality or in the same territory after completing all procedures.


  • ARTICLE 51-A (g) STATES:-
As per this article, "it shall be a duty of every citizen of India to protect & improve the natural environment including forests, lakes, rivers, and wildlife and to have compassion for living creatures."

According to this article, every Animal Lover is also protected under the Constitution. It means as an animal lover if you are facing any kind of problems or harassment it is your right to ask police officials for giving protection to you and your animals.


  • ARTICLE 19 THE CONSTITUTION OF INDIA:-
Article 19 deals with the right to freedom and in this freedom comes the right of the profession, occupation, trade, and business which means that if someone has taken the caring of animals as his occupation, it is legal and that person has every right to carry on with his occupation.

It means every person who wants to take care of any animal by giving them food or shelter to live along with his professional life can do this peacefully and this is totally legal according to the Constitution of India. 

Your office, Company, or Business or anything you are doing in your professional life can't stop you from doing this. Everyone has the right to carry on with his occupation.

  • ARTICLE 21 THE CONSTITUTION OF INDIA:-
According to this article, every person has the right personal life and liberty. It means if somebody wants to feed and provide shelters to dogs, he has at liberty to do so. He has the same rights to liberty that the law provides to every citizen of India.

Every citizen of India has full rights to feed and to give shelter to stray dogs if somebody can, nobody can stop anyone if they want to do a good deed for a stray dog.
